Introduction to the purchase of plots of land at Glengarry, Scotland.
The Land at Invergarry in Glengarry Scotland was the ancestral home to a branch of Clan Donald known as MacDonell. The area around the river Garry has been divided up into 1m x 1m Souvenir Plots of land as seen on the website, www.myglengarry.com. These plots of land may be purchased from myglengarry.com. As a Souvenir Plot Owner the new owner will receive a password for use on the myglengarry website. The new owner will receive by post, a title deed, map showing the location of the land, photograph of the area of land and a welcome letter from the trust who will manage the land on the owners behalf.
Owners will also be able, via the password, to access the members are and receive up to date activities of The River Garry Trust and Glengarry River Management Limited who have been established to protect and enhance the River Garry and its environs via allied projects. The owners may also click on their plot of land and upload a personal profile such as a message and photograph allowing other visitors to the site to find out who owns each plot of land.
For an extra annual sum, land owners may propose and vote upon projects that they feel will enhance the river Garry and its environs.
Owners may sell their Souvenir Plots only via this website. To avoid problems of probate - The Souvenir Plot Owner, will appear on the website as head of a list of co-owners of the souvenir plot. In the event of the death of the Plot Owner the ownership will pass next to a person on the list by following the procedures as set out on the website.
A person aged less than 18 years may not make a sale or transfer of a Souvenir Plot but a responsible adult providing name, address and age and being in possession of the Souvenir Plot password, will be accepted as acting for a minor.
Disputes as to Souvenir Plot ownership will be by the myglengarry web site Dispute Resolution procedure.
All owners of land agree to allow the River Garry Management Trust to manage the river and woodland on their behalf.
Web site moderation will operate in order to avoid undesired material appearing on or becoming associated with the web site.
Definitions:
'Souvenir Plot Owner' is the person identified as 'The Plot owner' on the face of the Deed of Title.
'The Land' is the land as owned by My Glengarry Ltd for the purposes of converting to 1 (One) square metre plots (approximately) for sale as Souvenir Plots. The Land boundaries and The Souvenir Plot(s) are as shown on the grid of 1 (One) square metre plots as appears on myglengarry.com. The Land relating to of any Souvenir Plot is the area of land situate and known by the plot number and shown on the 'My Glengarry' web site overlaying the aerial photograph.
'Souvenir Plot(s)' A Souvenir Plot or Souvenir Plots are a restricted form of land ownership:
Erect any form of fencing or boundary definition around The Souvenir Plot nor erect any form of structure whether temporary or permanent on The Souvenir Plot nor excavate nor remove substance from a Souvenir Plot nor fish on the river Garry for salmon or trout without written permission from the authorised letting agent nor fish for salmon on Loch Oich without written permission from the authorised letting agent nor plant any vegetation on Souvenir Plot nor restrict or charge for access of others to or across the Souvenir Plot nor to camp nor to make fires on the Souvenir Plot.
Visit, stand on, canoe or raft over the Souvenir Plot also photograph or electronically make temporary or permanent record of Souvenir Plots for their own use or for publishing or retention by other persons. Sell 'Souvenir Plot(s)' via the myglengarry web site.
'The River Garry Trust' is a non-profit making body established to represent the interests of the River Garry and those people who use the River Garry. Its role will be to make policy on environmental protection issues including access, fish and fishing and to put forward projects to be voted upon.
'Glengarry River Management Limited' is a company established to undertake, administer and oversee the projects proposed by The River Garry Trust and voted for action by Souvenir Plot Owners. The Souvenir Plot Owner by purchasing a Souvenir Plot has agreed that the Glengarry River Management Limited is the organisation to which a percentage of the sale of The Souvenir Plot will be paid towards the maintenance and upkeep of the River Garry and land immediately surrounding the river. The Souvenir Plot Owner has by this purchase agreed to Glengarry River Management Limited managing the Souvenir Plot or Plots on their behalf.
Where The Souvenir Plot Owner has decided to pay an additional annual maintenance fee for the continued upkeep, maintenance and sustainability of the specific My Glengarry river area and allied projects The Souvenir Plot Owner shall have a right to vote on projects proposed by the River Garry Trust. The number of votes that may be cast will be related to the number of Souvenir Plots in The Souvenir Plot Owners possession at the time of voting.
'Transfer of Ownership' the transfer of ownership of Souvenir plots shall be restricted to sale or transfer by inheritance within the methods available on the myglengarry.com web site. No Souvenir Plots may be gifted over.
'Dispute Resolution' as to ownership of Souvenir Plot(s) in the event of sale or transfer of Souvenir Plot(s) via the My Glengarry website shall be finally resolved by decision by My Glengarry Limited.
'Website Editing' refers to the process whereby My Glengarry Limited in their sole and absolute discretion may moderate or remove comments, views, photographs, links or any other material uploaded to any pages associated with Souvenir Plot(s) created on the myglengarry web site.
Returns policy
If for any reason you are unhappy with your purchase you can return it to us in its original condition within 30 days of the date you received the item and we will issue a full refund for the price you paid for the item. You can expect a refund in the same form of payment originally used for the purchase within 5 days of our receiving your return. If you require an exchange, please place a new order online.

Items returned because they are damaged, defective or incorrect
If you are returning an item because of an error on our part or because it is damaged or defective, we will refund the delivery charges incurred in sending the item to you and pay your costs of returning it to us by refunding your return postage costs. You can expect a refund in the same form of payment originally used for the purchase within 5 days of our receiving your return. My Glengarry will check all items returned as damaged or defective. In the event we find no fault, we reserve the right to re-charge you for the item/s and to recover our fees and expenses from you.
